GENERAL ITEMS

9. APPROVAL OF SUPPORT OF FSBA RESOLUTION IN OPPOSITION TO PROPOSED AMENDMENT 8
Description

The Florida School Boards Association has adopted a resolution in opposition to Amendment 8 on the November 2012 General Election ballot. The FSBA's resolution states it is opposed to Amendment 8 for numerous reasons including the fact that it would divert financial resources from the vast majority of Florida's PreK-12 students, and would encourage the proliferation of voucher programs that are not subject to stringent accountability standards and have not been shown to be academically beneficial to students.



Recommendation

That the School Board express its formal support of the FSBA Resolution in opposition to proposed Amendment 8.

The School Board offers enrolled students a Veterinary Assisting program and the Veterinary/Animal Care Facility manages a Veterinary/Animal Care Facility.  The School Board desires to provide to its students a clinical learning experience through the application of knowledge and clinical skills in a Veterinary/Animal Care Facility and the Veterinary/Animal Care Facility has agreed to make its facility available to the School Board for such purposes.



Recommendation
That the Affiliation Agreement between Fruitville Veterinary Clinic, P.A. and The School Board of Sarasota County, Florida be approved.

24. APPROVAL OF THE AMENDMENT TO THE CHARTER CONTRACT BETWEEN IMAGINE SCHOOL AT SARASOTA, LLC d/b/a IMAGINE SCHOOL AT PALMER RANCH CHARTER SCHOOL AND THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA
Description

The amendment to the charter contract reflects a modification to the school's curriculum and instructional delivery model. The proposed program modifications are at the request of the Imagine School at Palmer Ranch and have been reviewed by district curriculum staff for compliance with state and district requirements.



Recommendation

That the School Board approve the amendment to the Imagine School at Palmer Ranch charter as presented.

FIELD TRIPS

25. APPROVAL OF THE BOOKER HIGH SCHOOL FIELD TRIP TO NORFOLK, VIRGINIA ON MARCH 6, 2013 THROUGH MARCH 10, 2013
Description

Students in the Visual and Performing Arts Program will have the opportunity to take daily classes from industry professionals.  They will also have the opportunity to meet with college recruiters, audition for college and summer program scholarships and participate in on-stage performances.



Recommendation
That the Booker High School field trip to Norwalk, Virginia on March 6, 2013 through March 10, 2013 be approved.

EXPULSIONS

26. APPROVAL OF EXPULSION CASE NO. 12-448
Description

The student listed in Expulsion Case No. 12-448, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On April 26, 2012, the student listed in Expulsion Case No. 12-448, violated School Board Policy 5.322, Prohibition Against Use, Sale, or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent, that the student be expelled from the Sarasota County Schools until January 15, 2013.



Recommendation
That in accordance with provisions of Sections 1006.07(1)a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 12-448, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until January 14 of the 2012-2013 academic year.

27. APPROVAL OF EXPULSION CASE NO. 13-010
Description
The student listed in Expulsion Case No. 13-010, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On August 30, 2012, the student listed in Expulsion Case No. 13-010, violated School Board Policy 5.321, Possession of Weapons and Other Prohibited Articles.  It is the recommendation of the Superintendent, that the student be expelled from the Sarasota County Schools, until June 3, 2013.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 13-010, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2012-2013 academic year.

MATERIALS MANAGEMENT

30. APPROVAL TO RE-AWARD BID #12-0141 FOR ELECTRICAL SERVICES - TIME AND MATERIALS
Description
The bid for 'Electrical Services - Time and Materials' was awarded to Bay Area Electric, Inc., and Multiband Engineering and Wireless, Southeast, Inc., on June 5, 2012.  Multiband Engineering and Wireless, Southeast, Inc., has been non-responsive to the bid specifications so their bid award is terminated.  The bid is being rewarded to Bay Area Electric, Inc., and NCN Electric.    

Recommendation
That the bids of Bay Area Electric, Inc., and NCN Electric, to provide 'Electrical Services - Time and Materials' in an amount not to exceed $200,000.00,  be approved as presented.

31. APPROVAL OF INTERLOCAL AGREEMENT WITH THE BAY AREA SCHOOLS PURCHASING CONSORTIUM
Description
Staff requests approval of the Interlocal Agreement with the Bay Area Schools Purchasing Consortium to form a cooperative purchasing organization for the purpose of maximizing purchasing power in compliance with Florida Statutes 163.01 and 1001.42(25).  Each member district has determined that cooperative procurement strategies between similar agencies may lead to procurement efficiency and lower costs for common goods and services.  Member school districts are Brevard, Charlotte, Florida Virtual Schools, Hernando, Hillsborough, Lake, Lee, Manatee, Osceola, Pasco, Pinellas, Polk, Sarasota, and Seminole.

Recommendation
That the Interlocal Agreement with the Bay Area Schools Purchasing Consortium be approved as presented.

32. APPROVAL OF CLASSIFICATION OF INOPERATIVE EQUIPMENT AND FURNITURE AS PROPERTY TO BE DELETED
Description
The custodians of the property (cost center heads) have certified it to be traded in on new equipment, unaccounted for, not repairable or otherwise inoperable.  Property still on hand after reallocation will be salvaged for any useful parts and then sold at auction. 

Recommendation
That the classification of equipment and furniture, as property to be deleted, be approved.

CONSTRUCTION

33. APPROVAL OF ARCHITECT'S CONTRACT FOR THE SOUTH COUNTY BUS DEPOT
Description
The project's scope of work shall include design and construction administration for the construction of the South County Bus Depot buildings and related site work.  On 9/18/2012 (Item #29), the School Board authorized negotiations with this company.  The Director of Construction Services and one (1) member of the Professional Services Selection Committee (PSSC) met with a representative of Schenkel & Shultz, Inc. and successfully negotiated a contract.  The amount of this contract is $149,130.00.  These contract documents have been approved by the School Board attorney and are available for review at the Construction Services Department.  The construction budget is approximately $1,300,000.00.  Funds for this project are available in the capital budget account.

Recommendation
That the architect's contract for the South County Bus Depot project be approved as presented.

34. APPROVAL OF CONSTRUCTION MANAGER'S PRECONSTRUCTION SERVICES CONTRACT FOR THE SOUTH COUNTY BUS DEPOT PROJECT
Description
The project's scope of work shall include construction of the South County Bus Depot buildings and related site work.  On 9/18/2012 (Item #30), the School Board authorized negotiations with this company.  The Director of Construction Services and one (1) member of the Professional Services Selection Committee (PSSC) met with a representative from McIntyre Elwell & Strammer General Contractors, Inc. to negotiate a contract for this project.  This contract covers the pre-construction portion only for this project.  The contract for construction will be negotiated separately at a later date.  This contract amount is $6,000.00.  These contract documents have been approved by the School Board attorney and are available for review at the Construction Services Department.  The construction budget is approximately $1,300,000.00.  Funds for this project are available in the capital budget account.

Recommendation
That the construction manager's pre-construction services contract for the South County Bus Depot project be approved as presented. 

35. APPROVAL OF ADDENDUM TO THE CONTRACT BETWEEN OWNER AND ARCHITECT FOR DESIGN AND CONSTRUCTION ADMINISTRATION SERVICES (CONSTRUCTION MANAGEMENT PROJECT) FOR THE LAUREL NOKOMIS-HVAC RENOVATION PROJECT, CHANGING THE LEGAL NAME OF TOTeMS ARCHITECTURE, INC.
Description

On December 7, 2010, The School Board of Sarasota County, Florida and TOTeMS Architecture, Inc., a Florida corporation, entered into a Contract Between Owner and Architect for Design and Construction Administration Services (the "Agreement") for the Laurel Nokomis - HVAC Renovation project.  Effective August 16, 2012, TOTeMS Architecture, Inc. changed its name to Sweet Sparkman Architects, Inc., a Florida Corporation according to the Articles of Amendment filed with the Florida Department of State, Division of Corporations.  This Addendum is being entered into to memorialize the name change and to have Sweet Sparkman Architects, Inc. replace the name TOTeMS Architecture, Inc. as the Architect for Design and Construction Administration Services under the Agreement.



Recommendation
That the Addendum to the Contract for Architectural Design and Construction Services be approved as presented.

36. APPROVAL OF THE NON-EXCLUSIVE UTILITY EASEMENT AT THE NORTH COUNTY TECHNICAL CENTER-PHASE III BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA AND FLORIDA POWER AND LIGHT COMPANY
Description
This easement will assign an easement for the construction, operation and maintenance of underground electric utility facilities (including wiring, cables, conduit and appurtenant equipment) to be installed from time to time; with the right to reconstruct, improve, add to, enlarge, change the voltage, as well as the size of and the removal of such facilities or any of them within as easement ten (10) feet in width.  This easement has been approved by the School Board attorney.

Recommendation
That the Non-Exclusive Easement at the North County Technical Center-Phase III between the School Board of Sarasota County, Florida and Florida Power and Light Company, be approved as presented.

Included in these change orders are $287,116.81 credits for Direct Material Purchases; the corresponding Direct Material Purchase Orders of $270,676.24 result a net of $16,440.57 in sales tax savings.

38. APPROVAL OF ADDENDUM TO THE CONTRACT BETWEEN OWNER AND ARCHITECT FOR DESIGN AND CONSTRUCTION ADMINISTRATION SERVICES (CONSTRUCTION MANAGEMENT PROJECT) FOR THE BOOKER MIDDLE SCHOOL-HVAC RENOVATION PROJECT, CHANGING THE LEGAL NAME OF TOTeMS ARCHITECTURE,INC
Description
On February 7, 2012, The School Board of Sarasota County, Florida and TOTeMS Architecture, Inc., a Florida corporation, entered into a Contract Between Owner and Architect for Design and Construction Administration Services (the "Agreement") for the Booker Middle School-HVAC Renovation project.  Effective August 16, 2012, TOTeMS Architecture, Inc., changed its name to Sweet Sparkman Architects, Inc., a Florida Corporation according to the Articles of Amendment filed with the Florida Department of State, Division of Corporations.  This Addendum is being entered into to memorialize the name change and to have Sweet Sparkman Architects, Inc. replace the name TOTeMS Architecture, Inc. as the Architect for Design and Construction Administration Services under the Agreement.

Recommendation
That the Addendum to the Contract for Architectural Design and Construction Administration Services be approved as presented.

39. APPROVAL OF BUDGET AMENDMENTS FOR THE 2012-2013 FISCAL YEAR
Description

The Special Revenue - Federal and State Grants Budget Amendment Number One for the fiscal year 2012-2013 is deleting the 21st Century Grant for South County. The grant was unexpectedly denied due to the lack of funding available.

The Sales Tax Surtax III Budget Amendment Number One for the period of January 1, 2010 through December 31, 2024.  The sales tax estimated revenue has decreased by approximately 25% since the original estimate.  The major portion of the reduction is being taken from the New Future School Construction.      



Recommendation
That the budget amendments for the 2012-2013 Fiscal Year be approved as presented.

40. APPROVAL OF A REQUEST FOR A TWO YEAR EXTENSION OF THE MORATORIUM ON THE EDUCATIONAL SYSTEM IMPACT FEE
Description
On October 5, 2010, the School Board passed a motion requesting that the Sarasota Board of County Commissioners institute a county-wide moratorium on the imposition of the Educational System Impact Fee for two years.  On December 7, 2010 the Commission adopted Ordinance 2010-085 instituting such a moratorium for the period December 5, 2010 through December 14, 2012.  The School Board agrees that it is in best interest of slow economic recovery currently under way to continue this moratorium for another two years.

Recommendation
That the School Board of Sarasota requests the Sarasota Board of County Commissioners to adopt an ordinance suspending collection of the Educational System Impact Fee for all Principal Residential Uses where both (a) an application for the corresponding building permit is submitted to or accepted by the County or Municipality prior to November 30, 2014, and (b) the Certificate of Occupancy is issued on or before November 30, 2015. Unless negated by a future resolution of the School Board and action by the Sarasota Board of County Commissioners, the Educational System Impact Fee ordinance shall resume December 1, 2014, in its current form.
